Trial of Alleged Penske Shooter Postponed

On Jan. 12, 2010, Jesse James Warren allegedly opened fire inside the Kennesaw truck rental facility. Three people died. Two others were injured.

The trial of a man accused of shooting five people at the Hertz Penske Truck Rental facility in Kennesaw more than three years ago was supposed to start today.

But a medical evaluation of Jesse James Warren revealed that he is incompetent to stand trial at this time, according to the Marietta Daily Journal and the Atlanta Journal-Constitution.

Judge Mary Staley on May 9 directed the Cobb County Sheriff’s Office to transport Warren to the Georgia Regional Hospital in Atlanta for further psychological observation, according to the MDJ.

Warren, who worked as a truck mechanic for Penske from June 2005 until July 2009, allegedly opened fire inside the facility just before 2 p.m. Jan 12, 2010, according to the AJC.

Jaider Felipe Marulanda, 43, of Lawrenceville; Robert Gonzalez, 31, of Dallas, Ga.; and Vance Springer, 59, of Woodstock, were killed in the shootings. Two others, Joshua Holbrook of Cartersville and Zachariah Werner of Marietta, were injured, according to the MDJ.

Werner, who was left with a bullet lodged in his brain stem and is unable to function normally, filed a $20 million suit against business related to the Penske facility and Warren in June 2011, according to the MDJ. Holbrook and the widows of two of the men who died in the shooting also have filed suit.
